Privacy Policy

Effective Date: November 1, 2023

Welcome to the privacy policy of Oxycon products. This policy also applies to all other domains that we operate, including our entire range of services, products, content, and mobile applications (collectively referred to as the "Application"), which are owned and operated by Oxycon from Oxyconit.com, along with our affiliates and subsidiaries (henceforth referred to collectively as "Oxycon", "Oxyconit", "we", "us", "our").

The purpose of this policy is to succinctly explain how we collect, use, and disclose the personal information provided by users of our Application during the normal operation of our services. Any capitalized terms used in this Privacy Policy without definition possess their meanings as defined in our Terms of Service.

The term "Users" in this Privacy Policy refers to our customers who utilise our Services for data storage on our application.

We further detail how we handle personal information that we collect and use for our purposes (i.e., where we serve as a controller). This includes information regarding User Accounts, as well as information pertaining to how you interact with and use our Services. It also covers information you provide to our customer support and certain information relating to End Users.

Our use of cookies and similar technologies is also documented in this policy. For more comprehensive information regarding this, kindly refer to our Cookie Policy.

You're giving us consent to collect, use, and disclose your personal information in accordance with this Privacy Policy when you accept this policy during registration or by using our Services. The Privacy Policy is integral to our Terms of Service. We also want to inform you that the personal information that you provide through the Services could be transferred to countries other than your country of residence, including, for instance, servers in the United States. Your use of our services constitutes your express agreement to such transfer of data to the United States.

How We Use Your Information

We leverage the personal information in your file, along with other information stemming from your past and current activities on the Application, to provide you with services offered by the Application. This encompasses activities such as communicating with you about subscription purchases, resolving service disputes, diagnosing issues, gauging consumer interest in our products and services, informing you about online and offline offers, products, services, events and updates.

Beyond these, we send you information that is relevant to your interests, such as product news. We also customize your experience, shield ourselves against error, fraud, and other illegal activities, provide you with system or administrative messages, and undertaking any other activities described to you when collecting the information.

Furthermore, we employ your personal information to refine our marketing and promotional strategies, analyze Application usage, enhance our content and product offerings, and customize the content, layout, and services of the Application. Such adaptations serve to enhance the Application and to cater it more effectively to your needs. The ultimate goal is for you to enjoy an efficient, safe, and personalized experience when using our Application.

Information Collection

Our primary objective in gathering personal data from you is to facilitate a safe, smooth, and personalized user experience. This lets us offer services and features that better meet your requirements, and to personalize our service to enhance your safety and user experience. We restrict our collection of personal information to what we deem necessary to fulfill this purpose.

You can generally browse the Application without revealing your identity or sharing any personal information. However, once you register as a User or purchase products using our services, we do ask that you provide various contact and identity information and other personal data as requested in the relevant forms on the Application. At this point, we'll be able to identify you. On these forms, we highlight which fields are mandatory and which are optional. As you continue to use the Application, you may occasionally need to enter or send us further personal information.

However, you always have the choice not to share such information by opting not to become a User or by refraining from using the specific feature of the Application that requires said information.

Automatic Information Collection

We automatically track certain details about you based on your activity on our Application. This information helps us conduct internal research into our users' demographics, interests, and behaviour to better understand, protect, and cater to you and our community. Details that may be included in this information are the URL you visited just before ours (whether or not it's on our Application), the URL you visit next (regardless of whether it's on our Application), your computer browser information, your IP address, and your location.

Some of these details are collected automatically through cookies and similar technologies when you use our Services. For more detailed information on our use of cookies, please refer to our Cookie Policy. Other pieces of data are also collected automatically via your browser or device.

Please note that we employ cookies and additional tracking technologies within our Application to monitor and record all activities and communications related to the Application, with a view to improving its security, optimising user experience and analysing its usage, along with other reasons outlined in this Privacy Policy. By using our Application, you thereby acknowledge, agree to, and consent to, such monitoring and recording.

We may implement certain "Non-Cookie Technologies" on our Application, courtesy of our service providers, to assist our digital advertising initiatives. Commonly featured technologies include browser cache, locally stored objects, or the creation of a statistical identifier - a unique identifier (reminiscent of a cookie identifier) which is based on your browser or device characteristics that set it apart from others. These identifiers are derived either from data that your browser or device shares automatically or from additional data specifically solicited from your browser or device. For detailed information on this, kindly visit [this link](https://thenai.org/wp-content/uploads/2021/07/NAI_BeyondCookies_NL.pdf).

Additionally, we employ Twitter's Conversion Tracking and Tailored Audiences products. By using the Application, you're consenting to Twitter collecting non-identifiable data for analytic purposes. We use this data to improve our services and better understand our audience. This anonymous data is only used to gain insight into our user base and to evaluate potential features and advertising content to enhance the overall Application experience. At no point is your personal information linked to this analytic data by Twitter. You can learn more about opting out of this program [here](https://help.twitter.com/en/safety-and-security/privacy-controls-for-tailored-ads).

Further, if you use a Third-Party Service (such as Google) to create an account, the third-party service may automatically share your account information with us, like your name and email address (note: we don't store passwords you use to access Third Party Services). What they share with us is typically driven by your privacy settings on the Third-Party Service. We highly recommend reviewing their privacy policies and, if needed, amending your privacy settings directly on the Third-Party Service to ensure you're comfortable with the data they share.

Payment Information

We do not collect or save your credit card information when you use your card to subscribe to our Application or to purchase subscriptions. This is handled entirely by our payment processors. Nevertheless, we do receive limited payment card details from our payment processors, like the last four digits of your card, the country of issuance, and the card's expiration date. Our current payment processors are Stripe, Braintree, PayPal, Przelewy24, and iMoje. All payment details, invoicing and taxes are handled by InFakt invoicing app. You may want to review their terms of use and privacy policies for a more thorough understanding of how they handle your personal information.

Following your registration on the Application, you have the ability to review and modify your information in your account area. If you wish to delete any personal information that you've disclosed on the Application, kindly reach out to us via the contact information provided on the Application site.

Information Disclosure

We will not sell or rent your personally identifiable information to third parties without your express consent. The following outlines some of the ways your information might be disclosed in the regular course of business in order to provide our services:

Anonymized Aggregated Data: We aggregate and anonymize data for a variety of purposes. However, under these circumstances, we do not disclose any information that could be used to personally identify you.

Usage Data: We may share data regarding application usage with our Users. For instance, all data provided to our application can be shared among users, excluding any sensitive data that could be used to personally identify you.

Public Areas of the Application: Your activities in the public areas of the Application will be linked to your User ID, and other people can view the content you publish.

Subsidiaries, Affiliates, and Service Providers: From time to time, we may utilize the services of affiliates, subsidiaries, and unrelated service providers for the operation of the Application, which may include disclosing personal information to them to avail of their services. For instance, we might work with third-party hosting companies for hosting the Application, which may involve storing data, including personal information, on their servers. We supply necessary information to our fulfilment partners for processing orders placed with us. We also team up with third-party publishers, advertising networks, and service providers to manage our ads on other websites. Our third-party partners may set cookies on your device or browser to gather details about your activities on the Services and other websites you visit, to offer Oxycon ads tailored to you. For instance, if you visit Oxycon and also use a social media platform, you might see an Oxycon ad in your social media news feed or timeline. For more information about this, kindly refer to our Cookie Policy. We exercise due diligence to employ service providers that we believe are trustworthy and capable of meeting our expectations and yours in handling the confidential information.

Legal Requests, Emergencies, Jurisdictions: We cooperate with law enforcement inquiries and legally enforced requests for information. We also acknowledge the importance of responding to emergencies. As such, we might disclose User personal information in response to governmental investigations to ascertain our compliance with relevant laws, rules, and regulations; in response to lawful court orders, subpoenas, discovery requests; in compliance with any applicable laws, rules, or regulations; or in good faith, to safeguard or defend our rights or property or those of other users or End Users.

Should we sell our business, we might disclose personal information to the purchaser or its representatives, subject to the confidentiality agreements customary in such transactions.

Security Measures: Oxycon, Oxyconit products endeavour to safeguard your personal information. For transaction security, we use the Secure Sockets Layer (SSL) protocol, which encrypts any personal information you provide in the registration forms on the Application. This encryption process ensures your information's safety by encrypting it before it's sent to us from your computer. Moreover, we make commercially reasonable efforts to secure your personal information stored in our system. Unfortunately, perfect security in data transmission over the internet cannot be guaranteed. Hence, while we strive to secure your personal information, we cannot provide a complete assurance of the security of any information you transmit to us.

Retention of Your Personal Information

We hold on to personal information related to you or your use of the Services as long as your Account is active or as required to offer you or our Users the Services. Furthermore, we also retain personal information as long as necessary to fulfil the purposes outlined in this Privacy Policy, such as complying with our legal responsibilities, safeguarding ourselves in case of disputes, enforcing our agreements, and protecting our and others' interests.

The specific periods during which we store your personal information can vary based on the nature of the information and the reasons we need it. Factors we consider when determining these periods include the minimum required retention period mandated by law or recommended as best practice, the period within which a claim related to an agreement or other matter can be made, whether the personal information has been aggregated or pseudonymised, among other relevant factors. For instance, the time frame we retain your email address is tied to the active period of your Account, and the duration we keep a support message is based on the time elapsed since the last submission in the thread.

Since Users might return to us after an Account goes inactive, we don't immediately eliminate your personal information when a trial phase concludes or when you cancel all paid Services. Rather, we retain your personal information for a reasonable time period so that it's available if you decide to return in the future.

You may delete your Account by contacting us at [email protected], and we will erase the personal information we hold about you, unless we require it for the purposes laid out in this Privacy Policy.

Please be aware that in the course of offering the Services, we gather and maintain aggregated, anonymized, or de-personalized information that we may keep indefinitely.

Information Collectors Beyond Our Scope

Unless explicitly stated in this Privacy Policy, this document only discusses the utilization and disclosure of information we gather from you. If you disclose your information to other parties through the Application, including Third-Party Services, different rules could apply to their use, collection, and disclosure of the personal information you share with them. Since we do not control the policies of third parties regarding information use, collection, or disclosure, you are subject to their privacy policies. It's recommended that you ask questions before disclosing your personal information to others.

The European Union (EU), Switzerland, and the United Kingdom (UK): If you're located in the EU, Switzerland, or the UK, you have certain data protection rights:
Personal Data Rights:

Right to Know: You are entitled to know what personal information we collect and process about you, including the types and classes of personal information we gather and process, the sources of said information, our retention criteria, who we share your personal information with, any cross-border data transfers, and how to raise complaints or queries. This information is detailed in this Privacy Policy.

Automated Decision Making: We do not participate in activities that use solely automated processing, including profiling, to make important decisions that would have a legal or significant impact on our customers, Application users, or survey participants.

Access Rights: You can ask us if we are processing any of your personal information and, if we are, request access to it. When complying with an access request, we will also supply additional information, such as the reasons for the processing, the kinds of personal information involved, and any other information necessary for you to exercise this right.

Rectification: If your personal information is incorrect or incomplete, you have the right to have it corrected or completed. Upon request, we will rectify inaccurate personal information about you and, taking into account the purposes of the processing, complete any incomplete personal information, which may require us to provide a supplementary statement.

Erasure: You are entitled to have your personal information erased. This would mean that we, and where possible any other controller to whom your data has previously been exposed, would delete your personal information. However, the right to erasure is subject to legal limits and prerequisites. For example, your personal information can be deleted if it is no longer necessary for the original purposes of processing or if it was processed unlawfully.

Restriction of Processing: You can obtain the restriction of the processing of your personal information, meaning that we would suspend processing your personal information for a certain period. Situations that can lead to this right include when the accuracy of your personal information is disputed, but we need time to verify its accuracy.

Data Portability: You can request your personal information from us in a structured, commonly used, and machine-readable format, and have such data transmitted directly to another controller, where technically feasible.

Right to Object: You have the right to object to the processing of your personal information, which means you can request that we no longer process it. This is only applicable when "legitimate interests" (including profiling) serve as the legal basis for processing. However, you can object to your personal information being processed for direct marketing purposes at any time, free of charge.

Withdrawal of Consent: If we rely solely on your consent for the processing of your personal information, you also have the right to withdraw your consent at any time. However, withdrawals will not affect our legal basis to process the respective personal information prior to the withdrawal of your consent.

To exercise any of these data privacy rights, please get in touch with us, or have your authorized representative contact us, in line with the "Questions" section detailed below. For us to comply with the law, we will need to validate your identity (or the identity of your representative) and verify the legitimacy of your request.

Consent: Processing is conducted based on your consent (for example, when you register to receive our marketing materials or contact us voluntarily).

Legitimate Interests: Processing is necessary for our legitimate interests detailed in this policy (for example, monitoring your use of the Application and ensuring your compliance with its terms and conditions, or improving our Services).

Contractual Obligation: Processing is necessary for executing a contract in which you are a participant (for example, when you purchase or consider purchasing our Services).

Legal Compliance: Processing is mandated to comply with a legal or statutory obligation (for example, tax disclosures).

Complaints: If you have concerns about our data processing activities, you have the right to lodge a complaint with your data protection authority.
